BerryWell Institute

Privacy Policy

Effective date:

BerryWell Institute LLC ("BerryWell Institute," "BWI," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and retain information when you visit berrywellinstitute.com, use the Website’s Request a Demo, Request Access, or Contact forms, or otherwise interact with the public BerryWell Institute marketing website (the "Website").

This Policy applies only to the public marketing Website. The separate BWI simulator/learner platform, Admin Center, learner accounts, and related services have separate data practices and will be governed by their own privacy notices and terms.

1. Information We Collect

Information you provide. When you submit a Website form, we may collect your name, work email address, optional phone number, professional role, organization or program, inquiry type, responses to fixed-choice questions, a free-text message, and your agreement to be contacted about that inquiry.

Analytics information, if you opt in. If you select “Allow analytics,” the Website uses Google Analytics 4 (GA4) to help us understand Website use, including page views, calls-to-action, and completed inquiries. Google may receive ordinary connection and device information, such as your IP address, browser, and device characteristics. BWI does not send GA4 your name, email address, phone number, organization name, inquiry text, or inquiry identifier. Google Signals, advertising personalization, and automatic enhanced measurement are disabled.

Search performance. The Website uses Google Search Console for indexing and search-performance reporting. Search Console is verified through DNS and does not install a browser tag or set cookies on the Website.

Technical and security information. Our hosting and security infrastructure processes technical information needed to deliver, protect, monitor, and troubleshoot the Website. Operational logs are configured to exclude form message bodies and contact fields.

Analytics preference. The Website stores your analytics choice in browser local storage for 180 days so your preference can be remembered. That preference remains on your device and is not sent to BWI.

Patient and sensitive clinical information. The Website is not designed or intended to collect patient information, protected health information (PHI), medical records, or other sensitive clinical data. Please do not submit this information through a Website form.

2. How We Use Information

  • respond to demo, access, program, support, media, speaking, partnership, and other inquiries;
  • understand the role, setting, and goals of people interested in BWI;
  • provide requested information about BWI, demonstrations, and access opportunities;
  • route inquiries to the appropriate BWI team member;
  • operate, maintain, secure, troubleshoot, and improve the Website;
  • measure Website usage and performance when you have opted into analytics;
  • maintain appropriate business records related to an inquiry or business relationship; and
  • comply with applicable legal obligations and protect the rights, safety, and security of BWI, Website visitors, and others.

3. Cookies and Similar Technologies

When you submit a form, AWS WAF performs a browser security check and may set an aws-waf-token security cookie. This check processes browser and connection information to help prevent automated abuse. It is separate from optional analytics.

The Website does not use advertising cookies and does not require a login or account cookie for the public marketing site.

If you select “Allow analytics,” GA4 sets analytics cookies, including _ga and related Google Analytics cookies. If you decline analytics, the analytics tag does not load and analytics cookies are not set. You can still use the full Website.

The Website also uses browser local storage to remember your analytics choice for 180 days. You can change your choice at any time through “Cookie preferences” in the footer. Withdrawing consent stops future Website analytics collection and deletes analytics cookies that the Website can reach, but it does not erase information already received by Google.

4. How Website Forms Are Processed

The Website’s Request a Demo, Request Access, and Contact forms submit through BWI’s Website infrastructure hosted in Amazon Web Services (AWS) in the United States. The information is validated, transmitted through encrypted AWS services, and delivered to a BWI-controlled business email inbox.

The Website infrastructure functions as a transport and short-term recovery path rather than as a searchable lead or customer database. If the Website cannot confirm delivery, it may offer a pre-filled message that you can send through your own email application.

5. How We Disclose Information

We do not sell personal information, use Website inquiry information for targeted advertising, or add people who submit an inquiry to a general marketing list without separate affirmative consent.

We may disclose information as reasonably necessary to:

  • our Website development, hosting, security, maintenance, and support provider;
  • cloud infrastructure providers that process Website submissions;
  • our BWI-controlled business email provider;
  • Google Analytics, only when you have opted into analytics; and
  • legal, regulatory, or governmental authorities when required or permitted by law or reasonably necessary to protect rights, safety, or security.

6. Inquiry Communications and Marketing

When you agree to be contacted about your inquiry, you are consenting to a response about that specific request. That checkbox is not consent to receive general marketing email.

The Website is not currently connected to a CRM, mailing list, or email-marketing platform. If BWI later offers general marketing communications through the Website, we will use a separate affirmative opt-in and provide an unsubscribe method.

7. Retention

The Website’s submission infrastructure is intentionally short-lived. Successful inquiry queue records are removed after delivery; failed-delivery records may remain for up to 14 days; encrypted recovery copies expire automatically within 30 days; and operational/API logs are retained for approximately one month and exclude message bodies and contact fields.

To limit repeated submissions, the Website stores counters and a hashed version of the submitted email address in expiring records. These records do not contain the inquiry message and are scheduled to expire after two days; removal follows AWS’s automatic expiration process.

The business record of an inquiry is the copy delivered to BWI’s business email inbox. BWI generally retains that record while the inquiry or resulting business relationship is active and then deletes or archives it according to business and legal needs. Deleted information may remain temporarily in routine encrypted backups until the normal backup cycle overwrites it.

8. If Sensitive Clinical Information Is Submitted by Mistake

Website forms are not authorized for patient information, PHI, medical records, or sensitive clinical data. If BWI identifies such information submitted contrary to these instructions, BWI will take reasonable steps to delete it from active Website and business systems rather than use it for the inquiry, subject to applicable legal obligations and ordinary backup-retention cycles.

9. Security

BWI and its service providers use administrative, technical, and organizational safeguards designed to protect information handled through the Website, including restricted administrative access, validation and security controls, and encrypted transmission or storage where appropriate. No method of electronic transmission or storage can be guaranteed to be completely secure.

10. Your Choices and Requests

You may contact BWI to ask about personal information you submitted through the Website or to request correction or deletion where appropriate. Depending on where you live, applicable law may provide additional privacy rights.

To make a privacy request, email info@berrywellinstitute.com. We may need to verify your identity or clarify the information involved before completing a request.

11. Children’s Privacy

The Website is intended for healthcare professionals, professional students, educators, institutions, and other professional audiences. It is not directed to children under 13, and BWI does not knowingly collect personal information from children under 13 through the Website.

12. External Websites and the Separate BWI Platform

The Website may link to external websites or to the separate BWI simulator/learner platform. When you follow an external or platform link, the privacy practices and terms of the destination service apply.

13. Changes to This Policy

We may update this Privacy Policy to reflect changes in the Website, our practices, or applicable requirements. We will update the effective date when we make changes.
